1. Using Swept Design
These terms apply to the Swept Design service at swept.design, including its accounts, saved projects, vehicle swept path tools and drawing exports. We use “Swept Design”, “we” and “us” as the service name in these terms.
By creating an account or using the project and design features, you agree to these terms. If you do not agree, do not use those features. You must be able to enter into a binding agreement. If you use the service on behalf of an organisation, you must have authority to accept these terms for that organisation.
2. Your account
Provide accurate account details and use an email address you control. Keep your password and any connected sign-in account secure. You are responsible for activity you authorise through your account; tell us promptly if you suspect unauthorised access.
Saved projects are associated with the account that creates them. Do not share sign-in credentials to give another person access to your work. If you choose Google sign-in when available, you also need to keep access to that Google account.
3. Engineering checks and limitations
Swept Design is a design and analysis aid. It does not provide a site survey, professional engineering certification, a safety assessment or approval from a council or other authority. A displayed path or exported drawing does not by itself establish that a manoeuvre is safe, physically achievable on site, or compliant with a standard or consent requirement.
Before relying on results, you are responsible for checking:
- Site-plan accuracy, units, scale, coordinates, drawing placement and relevant site conditions.
- Vehicle dimensions, steering and turning inputs, speeds, poses, clearances and the assumptions used for the manoeuvre.
- Import and calculation warnings, omitted drawing content, and the geometry and units of exports in your receiving CAD application.
- The suitability of the results for your project, using independent checks and qualified professional review where appropriate.
The current model uses simplified, two-dimensional rigid-vehicle movement. It does not model articulation, four-wheel steering, tyre slip or vertical clearance. Curves and swept envelopes include numerical approximations, and DXF support does not cover every entity or format. Vehicle presets and references to AS/NZS or Austroads material do not constitute certification, endorsement or a guarantee of compliance. Independent validation of source vehicle dimensions and published turning templates remains outstanding.
Do not disregard warnings or present an unchecked output as a verified design. These responsibilities do not remove any rights or remedies that the law gives you.
4. Your drawings and projects
You and your licensors retain your rights in uploaded site plans, project content and the designs you create. We do not claim ownership of your drawings because you use the service. You may use your exported designs for personal or commercial work, subject to these terms and any rights belonging to other people.
You give us a non-exclusive permission to store, copy, process and display your content only as needed to operate the service for you, provide support you request, and protect the service. This includes using hosting and database providers for those purposes. It does not give us permission to publish your private projects as examples or use them in marketing without your agreement.
You must have permission to upload and use any client drawings, third-party material or personal information you provide. Keep your original files and suitable copies of important outputs. Autosave depends on a working connection and successful saves; it is not a substitute for your own records. Check the save status before closing your work.
You can delete projects and uploaded drawings through the app. Our permission to handle deleted content ends when it is no longer needed for the service, except for retention described in the privacy policy or required by law.
5. Acceptable use
Use Swept Design lawfully and in a way that respects other users. You must not:
- Access or attempt to access another person's account, drawings or projects without permission.
- Upload material that infringes intellectual property, confidentiality or privacy rights.
- Introduce malicious code, disrupt the service, or deliberately overload it with requests or files.
- Bypass authentication, access controls, rate limits or other safeguards.
- Misrepresent the service's results as certification or claim an endorsement that has not been given.
If you find a security problem, report it to us without accessing other users' information or disrupting the service.
6. Early access and availability
Accounts, saved projects and DXF exports are currently free during early access. There is no paid subscription or automatic billing at present. If we introduce paid features, we will explain the price and applicable terms before you choose to purchase them. Creating a free account does not authorise future charges.
Early-access features may change as we fix issues and develop the service. We aim to keep it available, but do not promise uninterrupted access, error-free results or compatibility with every browser, drawing file or CAD application. Maintenance, internet problems and provider outages can interrupt access or saving.
If we plan to discontinue the service or materially remove access to saved work, we will give reasonable advance notice and an opportunity to export available drawings where practicable. Urgent security issues or legal requirements may require us to act sooner.
7. Software and other rights
We and our licensors retain rights in the service's software, interface, branding and other materials, separate from your content. These terms allow you to use the service for your own or your organisation's design work; they do not transfer ownership of the service to you. Any open-source components or separately licensed materials remain subject to their own licences.
Rights in third-party drawings, standards and other reference materials remain with their owners. Access to the service does not grant a licence to reproduce a standard or other material beyond what its owner or the law permits.
8. Privacy and external services
Our privacy policy explains how we handle account information, saved drawings, session data and privacy requests. Uploaded drawings and saved design state are stored on our servers, not only on your device.
The service relies on external hosting, database, email and font services, and may offer Google sign-in. When you use an external service directly, such as your Google account, its own terms and privacy policy also apply. This does not remove our responsibility for obligations we owe you under applicable law.
9. Suspension and account closure
You can stop using Swept Design at any time. To request account closure and deletion of associated projects, email privacy@swept.design. We may need to verify that you control the account. Export any drawings you need before requesting deletion. Signing out or disconnecting Google does not itself delete your account.
We may restrict or suspend access where reasonably necessary to address a material breach of these terms, protect users or the service, or comply with law. Where practicable, we will explain the reason and give you an opportunity to resolve the issue. We may act immediately where there is an urgent security or legal concern. You can contact us if you think a restriction is mistaken.
Account closure does not remove rights or obligations that arose beforehand. Content retention and deletion are handled as described in the privacy policy.
10. Responsibility and your rights
Nothing in these terms excludes, restricts or changes any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or changed. This includes rights under the New Zealand Consumer Guarantees Act, Fair Trading Act and Australian Consumer Law where they apply. The service's early-access or free status does not override those rights.
Subject to those protections, we do not guarantee that the service will meet every project's requirements or that an authority will accept an output. To the extent the law permits, we are not responsible for loss caused by incorrect information you provide, use outside the stated model limitations, or a failure to carry out the checks described in section 3, except to the extent our own breach or negligence contributed to that loss.
Neither party is responsible to the other for loss that was not reasonably foreseeable when these terms were agreed, to the extent permitted by law. Nothing in this section excludes liability for fraud, deliberate misconduct, or any other liability that the law does not allow to be excluded. You retain access to any remedies available under applicable law.
11. Changes to these terms
We may update these terms to reflect changes to the service, legal requirements or security needs. We will publish the updated terms here and revise the date above. For material changes, we will give reasonable advance notice through the service or your account email where practicable, explain when they take effect, and obtain your agreement where required.
Changes apply prospectively and do not remove rights relating to an earlier event or dispute. If you do not agree to an update, you can stop using the service and request account closure.
12. Questions and disputes
Contact Swept Design at privacy@swept.design with questions about these terms or a problem with the service. Explain what happened and identify the account or project involved, but do not send your password.
We will try to resolve concerns fairly. Contacting us does not prevent you from using a court, tribunal, regulator or other remedy available to you under applicable law. If a provision of these terms cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
